How to effectively, legally remove a guest

While most hoteliers are hard-wired to welcome guests, on occasion they are faced with the unenviable task of asking (or forcing) offending guests to leave. 

REPORT FROM THE U.S.—While the hotel industry was built on the premise of welcoming guests, hoteliers often are faced with the unenviable task of removing them. Such scenarios require a sound understanding of legal grounds and the ability to navigate potentially combustible face-to-face interactions, according to sources. 
The potential scenario was highlighted recently in Greenwood Village, Colorado, where members of city council on Monday passed an ordinance prohibiting hotel stays of longer than 29 days.
The city claims the move is needed to curtail calls for police service, which are considerably higher at the four hotels in town that permit people to live there. Also, hotels, which lack residential zoning, are not equipped to operate as long-term living facilities.
Similar length-of-stay provisions exist throughout the country. Beyond those examples, there exist several other legally sound reasons for removal of guests. 
Under what circumstances can I remove a guest?
“You need certain rules to evict a guest. You can’t just arbitrarily evict them,” said Joe McInerney, president and CEO of consultancy McInerney Hospitality International and former head of the American Hotel & Lodging Association. 
Stephen Barth, professor of hospitality law, University of Houston, and founder of, cited four reasons:
  1. if the guest does not pay or lacks the ability to pay;
  2. if the guest overstays beyond the dates specified in the reservation contract (although this can be state-specific);
  3. if the guest is drunk, disorderly or otherwise creates risk of harm to employees or other guests; and/or
  4. if the guest is violating the law. 
In “The ABC’s of evicting guests,” the California Hotel & Lodging Association cites another: if the guest is ill with any “infectious, contagious or communicable disease.” 
What’s the difference between a transient guest and a tenant? 
Worth noting in the discussion of legal grounds is the difference between a hotel guest and a tenant. 
“In general, a ‘transient guest’ is an individual who rents property for a relatively short period of time with no intent of establishing permanent residency. Conversely, a ‘tenant’ rents property intending to become a long-term resident and the property is her or her mailing address and ‘home,’” according to a an article from the Texas Hotel & Lodging Association titled “When guests overstay their welcome.” 
Complicating the definition slightly is the extended-stay hotel segment, which routinely and intentionally houses guests for periods ranging from several days to weeks or months. Municipal laws typically recognize this class of hotel, as is the case in the Greenwood Village ordinance, which does not apply to extended-stay hotels. 
The laws governing transient guests and tenants vary significantly, Barth explained. 
 “The general rule is that innkeepers are much different than landlords because innkeepers are generally dealing with transient guests as opposed to tenants,” he said. “When we think of an innkeeper-guest relationship, we think of locking out a guest rather than evicting a tenant.”
The term “eviction” legally applies to landlords who file and win an unlawful detainer. Hoteliers, on the other hand, rarely have to make such filings. 
How do I notify the guest it is time to leave?
Hoteliers who are uncertain regarding their legal standing are encouraged to contact their local or state hotel association or attorney for advice, sources said. 
Hoteliers also must be sure to conduct the removal in a reasonable manner and at a reasonable time, according to “The ABC’s of evicting guests.”
“The mere fact that an innkeeper has a legal right to evict someone does not give the innkeeper the right to carry out the eviction in a manner that would place the person in a position of harm. For example, a seriously ill guest should not be summarily thrown out into the winter elements,” the article explains. 
The verbal exchange must be carried out in a professional manner, free of insulting language, intimidating conduct or other offensive actions that could lead to liability elsewhere, such as defamation, humiliation or infliction of emotional distress, according to the article. 
Also key to the exchange with the guest is transparency, Barth said. Hoteliers should be upfront and direct, explaining why the guest is required to leave the hotel. 
Some associations will provide customized written notices that spell out the details, but they are not needed in every instance. 
Good, common sense should be the guiding principle, McInerney said. 
“You’re going to be dealing with different offenders here,” he said. “Each one is different.”
What if a guest refuses to leave? 
In the event a guest is unreasonable or unwilling to comply with the request, hoteliers can change the keycard the first time that guest leaves the room.  
Hoteliers should undertake certain precautions when doing so, Barth explained. Locking out a guest effectively creates what he called a “bailment situation” because the hotelier is taking possession of the guest’s property. 
Hoteliers must keep guests’ belongings safe until they return. Hoteliers should also create an inventory of each item, preferably through a video log via smartphone camera, in the event the guest files a complaint alleging theft or damaged property, he said. 
When locking a guest out is not an option or would not create a reasonably timely resolution, sources recommended hoteliers call police. 
Is there anything else I should remember? 
“It’s best to keep a diary, a chronological history of what’s occurring,” Barth said. A detailed history not only can protect the hotelier in the event of a retaliatory legal action, but it also removes all doubt when police must be called, he said. 
Both Barth and McInerney said hoteliers should be transparent about check-out dates, pricing policies and other issues upfront. Front-desk associates should circle check-out dates on the registration card and require guests to initial, indicating the guest has reviewed and will comply. 
McInerney also said there is strength in numbers. When confronting a guest, “never do it by yourself,” he said. Bring backup in the form of another associate or employee.

    I have a question regarding extended stays. In Texas generally, if a guest stays in one room for ten days, moves to another room for 15 days, and then to another for 15 days, is that an extended stay, or does the person need to stay in the same room for 30+ days for it to be an extended stay?

    Responding to C Bauer's question above. We are an extended stay property in the Dallas, TX metroplex. Our property considers the guest's overall check-in and check out dates to determine the type of stay, with anything over 30 days qualifying as an extended stay. In the situation above our property would not "reset the clock" if a guest has switched rooms, as they still remain our guest residing on our property. Hope this was helpful.

    I have a question about eviction from a hotel. If the guest does not perform any of the cited reasons for eviction can they still be evicted without cause.

    I am a permanent resident in a hotel in( writing from the GM ) and have been given a state hotel tax exemption from the hotel. This is in Houston, Texas. I have been here for 45 days or more. The Hotel has accepted partial payment on my bill. However all indications are that they are going to evict me. What is my standing.

    I have a guest that has been here since 2016 and pays weekly, there has been many complaints about this guests the last one being harboring a fugitive and having warrants himself, causing a search of his room by 3 different police agencies, all incidents have been recorded in a daily log. We have given him two weeks to get out and he refuses. How to get him to vacate we did give him a letter to vacate and he blacked out the date.

    In May and June, 2017 I was working for the campaign of a candidate for mayor in New York City. We had a campaign issue that required me to be in Trenton, NJ on a two dates in June, 2017 at the NJ Secretary of State Office.

    The hotel I was staying at was closed by the
    Division of Fire Safety of the State of New Jersey.

    The hotel would not return the rent money
    for the room of a two day period. The hotel
    is still closed now for over a year.

    What is the New Jersey State Law on the
    hotel keeping the rent money if the guests
    were evacuated by an order issue by the
    Government of the State of New Jersey?

    I live in an extended stay hotel just like a lot of people here pain management make you move out if you invite another guest that lives in your in the hotel can they evict you for having another guest in your room visiting if you work here in the hotel as an employee?

    I’ve been at the Extended Stay in California for 6 months always paid in full the 2 months required by epp except for this last month (the 6months) I’ve hard trouble coming up with the whole amount and they have a new manager. She told the staff to not take any partial payments from me and gave me 3 days to leave. I went on to speak to her telling her I will have the full amount required $597.00 and she responded not to pay. Saying I didn’t have to also that even if I pay I must leave. Last night a company came and put two 3 day notices and two 30 day notices on my door. I feel descriminated against and I truly do not want to I am calling an attorney to find out my rights though this does not seem right! She doesn’t want to take my money. I did nothing wrong but I am black. Is this a Discrimination situation?

    Im in a motepl 6 in ft lupton colo! Ive been here for about 3 monyhs! There,s no complaints! Ive always paid my room on time and a week at a time! I got a call from the frt desk saying i need to vacate the room in the morn by 11am! Is this legal? Thanks!

    Beware of the few hotels that only take cash. My experience was at the St Marks Hotel (2 St Marks Pl, New York). I wasn't allowed to check in because I needed to pay with a credit card. The hotel's website said they accepted cash but didn't say they ONLY accepted cash.

    I live at extended stay in Houston Texas I have been here since November 15th 2019 I have been having trouble with the management here she comes in my room whenever I'm not home she goes through my personal belongings she also wanted to come back and redo another inspection so she say and I refused now she wants to evict us and said that I have to be out in one day but don't want to give me my money back am I entitled to leave or do she have to file proper eviction papers

    I have heard of a person stay at an extended stay inn in the area of Houston, TX. They paid part of their bill up front on their arrival. They have been there about a month. During that time, the management tool possession of some mail addressed to them in lieu of payment had them sign an agreement that they would pay the remainder of their bill when they return to NY.
    To make a long story short, they are stuck in Houston with a check they can't cash, no credit cards, a bill they can't pay, and now they extended stay inn won't let them leave. They missed a flight a friend paid for to get them to NY.
    How can they make them stay? This is only added to the bill.

    I have been at the same hotel since September, 2nd now its September 26th I have made all payments on time I have never not paid and now today I have been told that I did not pay on the 22nd of September when i did i have all proof of all my transactions and payments the stress they put me threw once i proved to them that i have made that payment now I'm being told that i need to leave you got to be kidding me completely unprofessional.
